This includes verifying compliance with convention standards, crewing regulations, and adherence to applicable international rules for safe and efficient operation.

The primary objective of PSC is to rectify and eliminate deficiencies found in non-compliant ships, thereby enhancing the safety of vessels, safeguarding the well-being of individuals on board, protecting property, preserving the marine environment, and fostering economic and trade development. Through these measures, PSC aims to elevate the standards of shipping operators and contribute to the overall improvement of maritime practices.

The United Nations Convention on the Law of the Sea

The United Nations Convention on the Law of the Sea (UNCLOS) 1982 explicitly articulates that each State is mandated to actively exert its jurisdiction and control in administrative, technical, and social aspects concerning ships registered under its flag. This entails that every State must implement requisite measures for ships flying its flag to guarantee safety at sea, encompassing:

(a) Ensuring the adequacy of construction, equipment, and seaworthiness of ships.
(b) Overseeing ship manning, labor conditions, and crew training, emphasizing the importance of these aspects in maritime operations.

Obligations of the Flag States

Regrettably, the flag states have fallen short of meeting their obligations. The emergence of flags of convenience has shifted the focus of open registry flag states towards registration taxes, neglecting their responsibility to effectively manage the fleets under their flags. Consequently, they have not adequately fulfilled their international duties as flag states. Furthermore, some have been remiss in conducting Flag State Control (FSC), prioritizing commercial aspects of registration over compliance.

In this practice, the genuine link required by UNCLOS between the flag state and the registered ship is absent.

In response, port states have initiated actions to safeguard their own interests. When Recognized Organizations (RO) and flag states fail to adhere to the relevant international conventions set forth by the International Maritime Organization (IMO) and International Labour Organization (ILO), Port State Control (PSC) steps in to rectify substandard ships. PSC is considered a supplementary measure to Flag State Control (FSC) and serves as the last line of defense.

PSC Inspection Results

PSC inspections typically yield one of three outcomes. First, a ship may exhibit no defects, allowing it to pass through PSC smoothly without any issues. Second, a vessel may display some defects, but they are not severe enough to warrant detention. Third, if deficiencies are deemed serious and could pose a threat to maritime safety unless addressed, the ship is subject to detention. Once detained, the vessel incurs deferred loss and high repair costs. Simultaneously, this adversely affects the reputation and image of the ship company and the flag state, leading to significant consequences.

Recognizing the potential repercussions, shipping companies prioritize the quality standards of their ships, striving to enhance both the vessel's hardware and software elements. This proactive approach aims to ensure that the ship successfully navigates PSC inspections, avoiding detention and the associated substantial losses. In practice, the reasons for PSC detentions vary. Some stem from the ship's poor quality and defects, while others result from inadequate inspections by port state control authorities. In instances of unjustified detention, the affected vessel retains the right to file a compensation claim against the port state.

The new inspection regime(NIR) came into effect on 1, January, 2014 in the Asia-Pacific region. Under the NIR, ships would be divided into three categories:


1. High risk ships- HRS


2. Standard risk ships- SRS


3. Low risk ships- LRS


Under the NIR, different time windows/inspection intervals would be applied to the corresponding categories of ships in accordance with the risk levels so that high risk ships would be subject to more frequent inspections while the quality/low risk ships would be awarded with a wider time window for inspections.

The following elements will be taken into consideration when calculating the risk level, performance of the flag of the ship (e.g. Black or White List of flags, status on completion of the Voluntary IMO Member State Audit Scheme (VIMSAS)), type of ship, age of ship, performance of RO, performance of the company responsible for ISM management number of deficiencies, number of detentions.

As is shown in the figure, different risk level, different time window. Ship Risk Profile Time Window since previous inspection:

Low Risk Ships 9 to 18 months;

Standard Risk Ships 5 to 8 months;

High Risk Ships 2 to 4 months.

The cycle of time window will be re-started for the ship after an inspection.

USCG

The US Coast Guard (USCG) has been playing an important role in protecting the safety of life and maritime environment. USCG has made tremendous contributions to the world. The US does not join any one MoU, but as observer member. USCG carries out three basic roles: maritime safety, maritime security and maritime stewardship. The PSC conducted by USCG is drastically different from other
regional PSC regimes based on MoUs, it stands outside the regional regime. The USCG implements its PSC on the national level based on US legislation through its PSC programme.

The analysis of undue detention and negative impact.

As we all know, PSC plays an important role in promoting ships to strictly implement relevant international conventions, meet the relevant safety and pollution prevention standards. The aim of the PSC is to eliminate sub-standard ship out of the navigational trade. In recent years, although the flag state , shipowner and operator have taken effective measures to keep ship in good conditions, many rows of ships in foreign Port State Control are still repeatedly detained. Of course, there are many reasons for delaying, like poor technical condition of the ship, the poor shipping company safety management, lower quality of prime crew. PSC undue detention is also serious, and the reason is complex.


Definition of undue detention

Undue detention is delineated in the "Procedure for Port State Control, 2011" as follows: when the condition of a ship or its crew substantially fails to meet the requirements of the relevant international convention, PSC officers take action to ensure that the ship poses no danger to the marine environment or the individuals on board after departure. This holds true irrespective of whether such measures disrupt the ship's planned departure. In my view, undue detention can be interpreted as the PSC officers detaining a ship without evident grounds to substantiate the claim that the vessel fails to meet convention requirements.

As there is no established criterion for categorizing a ship as substandard, Port State Control Officers (PSCO) must rely on their professional expertise to assess whether a ship's defects may jeopardize the safety of the vessel, its crew, or the marine environment. When external factors disrupt the PSCO's evaluation, it becomes challenging to make accurate assessments, leading to unwarranted detentions. Undue detentions have adverse consequences for the ship, the flag state, and the shipping company. Therefore, it is crucial to bring attention to the issue of unjustified detentions.

Detention of a ship without legal basis

Detaining a ship without a lawful foundation involves two distinct scenarios. Firstly, it refers to maritime authorities exceeding the bounds of domestic laws and regulations specified in pertinent international conventions when detaining ships. In other words, this involves actions that go beyond the scope of applicable domestic laws and international maritime agreements. Secondly, it encompasses instances where the Port Maritime Organization, during the execution of detention procedures, engages in unwarranted detentions due to the misuse of discretion or the influence of subjective factors by PSC officers.

The reasons for the complexity in ship detentions

The reasons for the complexity in ship detentions are multifaceted. Firstly, PSC officers follow PSC procedures based on the International Convention and certain domestic laws. Disparities in inspection and enforcement standards exist among various regional PSC organizations and member states within the same Memorandum of Understanding (MoU) framework. Additionally, the content of the Convention undergoes continuous updates and amendments, making it challenging for some Port State Control Officers (PSCO) to stay abreast of changes in a timely, accurate, and comprehensive manner.

Divergent interpretations of legal provisions, distinct policies across different ports, and varying perspectives among PSCO during inspections contribute to different outcomes in PSC enforcement. For instance, applying terms intended for large tonnage ships to smaller vessels, using terms applicable to special ships for ordinary ones, or applying terms for existing ships to new ones can lead to inconsistent results. An illustrative example involves a PSCO insisting on the installation of an oil discharge monitoring device on the oil-water separator of a small vessel, despite no mandatory requirement for ships with a gross tonnage of less than 10 thousand tons in Annex I to the MARPOL 73/78 Convention.

Political or personal influences

The port state authorities or PSC officers deliberately breach regulations, leading to the unwarranted detention of ships. Inconsistencies in political systems and views often give rise to political or economic conflicts between countries. Consequently, during PSC inspections by port state authorities, the unjustifiable detention of ships frequently occurs due to considerations of political factors or individual biases. Such detentions may result from personal vendettas or the heightened tension between governments due to diplomatic relations between the concerned countries.

Instances arise where, during inspections, PSC officers, enticed by financial gains, misuse their authority, willfully disregarding international conventions or relevant state regulations on PSC. This deliberate misconduct leads to the unjustifiable detention.

On-site defense proves to be the most direct approach, circumventing intricate review processes and promptly rectifying unjust treatment of the ship. It should be the primary recourse when a ship encounters unfair treatment. However, the effectiveness of this measure relies on the proficiency of the crew and the cooperative conduct of the PSCO. The captain must possess a thorough understanding of relevant conventions, and the PSCO should handle any disagreements regarding inspection findings with composure and patience.

Appeal to port state

In instances where the shipowner or operator perceives wrongful enforcement actions by the port state, resulting in undue losses for the vessel, an avenue for recourse is to file a complaint directly with the port state rather than pursuing legal channels. Upon receiving the complaint from the affected ship, the port state conducts an investigation within a specified timeframe and subsequently implements appropriate measures based on the investigation's findings.

Should the shipowner remain dissatisfied with the outcome of the complaint, there is the option to escalate the matter by submitting an appeal to a Memorandum of Understanding (MOU).

In comparison to a memorandum review panel, the port state review offers a more direct approach. If handled expeditiously, this process has the potential to annul improper measures, thereby mitigating or entirely eliminating the losses incurred by the ship.

Political or personal factors

Memorandum of Understanding is an intergovernmental agreement signed between countries within a geographical region, mainly responsible for coordinating the PSC activities of the Member States and building information database and sharing the PSC information.

If the shipowner is not satisfied with the reply of the port state, he may appeal to the Tokyo MoU secretariat within three months from the date of detention. Secretariat will set up a "review group", including its own and members of the memorandum of understanding. The members of the review panel will not include the port state and flag state in appeal happens. The review panel will consider the control procedures. Based on the information of the flag state and / or recognized organization and port state within 30 days from the date of receiving the application, the Secretariat will prepare a summary of the views of the review group, and will notify of the situation to the flag state, RO, the port state and memorandum of understanding advisory board. If the review panel supports the flag state or RO, the port state will be suggested to reconsider its decision can be a legitimate reason for the port state to modify the data within the system.

However, numerous issues persist, and the impact of filing a complaint is constrained by the memorandum. This limitation primarily stems from the following reasons: 

Firstly, only the flag state and Recognized Organization (RO) possess the right to appeal to the Memorandum of Understanding (MoU), with ship owners and operators lacking the privilege to lodge a complaint. 

Secondly, the MoU itself lacks enforceable authority; if the review committee deems a detention inappropriate, it cannot directly release the detained ship but can merely recommend that the port state reconsider the detention decision. 

Thirdly, the findings of a review committee under an MoU cannot serve as evidence to support economic compensation claims for the affected ship. 

Lastly, the procedures involved in MoU reviews are protracted and cumbersome. The efficacy of MoU appeals is somewhat restricted since the MoU functions solely as a coordinating agency and cannot intervene in the exercise of administrative powers by its member states.

The ramifications of unjustifiable detention

The detention by Port State Control (PSC) significantly impacts the ship owner in several ways. 

Firstly, there's the loss of time. Information regarding detention on the port state's website reveals delays ranging from one hour to several days.

Secondly, there's financial loss encompassing crew wages, fuel expenses, port charges, liquidated damages resulting from delivery delays, and substantial repair costs. For ship owners, time equates to monetary value. Thirdly, there's damage to reputation and image. A ship frequently detained risks placement on a blacklist, subjecting it and other vessels from the same shipping company to frequent inspections. This detrimentally affects the shipping company's reputation, as well as the flag state and Recognized Organization (RO).

Administrative proceedings

PSC is a kind of administrative act. When the ship suffered undue detention and huge loss, the shipowner or manager can proceed directly to the high court, applying for state compensation. 

If the ship owner refuses to accept the decision of the administrative organ, he may lodge an administrative lawsuit directly. The administrative litigation is to review and make the judgment by the court to conduct the specific administrative act of the administrative organ.

To resolve administrative disputes, the core of administrative litigation is to examine the legitimacy of the specific administrative acts, In principle, it does not belong to the scope of the review of the court however, if the administrative punishment is obviously unfair, the administrative enforcement is obviously improper and so on. The court may still have right to review the legitimacy of the administrative sanction and the right to make a decision.

Laws about succor of undue detention

The laws about succor of undue detention caused by Port State Control can be roughly divided into three categories, namely international maritime conventions, MOU appeal panel and internal laws.

Port State Control ကြောင့် ဖြစ်ပေါ်လာသော မလျော်ကန်သော ထိန်းသိမ်းမှုဆိုင်ရာ ဥပဒေများကို အမျိုးအစားသုံးမျိုး ခွဲခြားနိုင်ပြီး အပြည်ပြည်ဆိုင်ရာ ရေကြောင်းသဘောတူစာချုပ်များ၊ MOU အယူခံအဖွဲ့နှင့် ပြည်တွင်းဥပဒေများ၊

International maritime conventions

International maritime Conventions are international conventions related to maritime affairs. They refer to international legal documents negotiated and formulated by IMO or member states in accordance with certain procedures and principles, mainly in order to regulate relationships between rights and obligations of such aspects including technology, personnel, security and efficiency linked to maritime navigation. 

For instance, UNCLOS, MLC and LLC all belong to international maritime conventions. International maritime conventions are the most direct basis for succor of inappropriate detaining. In UNCLOS, article 226 and 227 provide range of actual survey to foreign vessels, nondiscrimination of foreign vessels. Article 232 provides that in order to prevent, reduce and control marine pollution. 

If the taken measures are illegal or beyond reasonable requests, states in implementation of these rules or in domestic legislation may bring the so-called results to court. It is also provided that states should develop regulations to avoid such harms and lawsuits. SOLAS, MARPOL73/78, LOADLINE 66, STCW78/95, etc. are all provided for the implementation and requirements of international maritime conventions as far as possible to prevent inappropriate ship detaining and delay. Once undue detention or delay occur because of convention implementation, the injured party may be compensated for the resulted loss. Procedures for Port State Control provides that PSC officials in exercise of ship detaining shall inform the captain that he has right to appeal against undue detention or delay.
